2024-01-12 Fulton County RICO Hearing Major Motions, (Stocton for Giuliani) wants to compell interviews with cooperating defendants who have plead guilty. It appears that interviews will be possible without 'compelling'. Prosecution is requesting to be present or be provided with recordings. Devense position is that they should be given access IF the defendant wishes it, but not at the state's insestance. The state is insesting on access to verify that there is no intimidation, violation of probation conditions, and recording would provide a more efficient process considering the scope of the case. Stocton assures judge that Giuliani will not be attending interviews. Judge will file brief. Defendant cannot be compelled to participate in an interview, and they can set conditions, such as the attendance of a state representative. Another motion was had been by Giuliani's previous counsel, many issues have been addressed. Some open issues remain, but will be considered in the near future. Stoction raised double jeopardy concerns for prosecutions in other states on similar charges, but judge suggests that each state can file independent charges without raising double jeopardy issues.
